It's Not Over Until It's Over: Post-Judgment Relief
Ernest L. Eady, attorney at law, Orange, California
When a conviction is handed down by a court, most people think the case is over. It's simply not so. A skilled, experienced attorney can often obtain for a client post-judgment relief expunging a criminal conviction or withdrawing a guilty plea or terminating a probation sentence early. Post-judgment relief takes many forms, dependent in large part on the circumstances of your case and your behavior.
If you would like your situation assessed by a lawyer experienced in obtaining post-judgment relief for a wide variety of clients, call the Law Offices of Ernest L. Eady at 714-656-2900 to schedule a free appointment. My office is near the Garden Grove Freeway/Route 22, next to The Block shopping center in Orange, California.
How I can help you after a conviction
- Probation violation: If you have a probation violation, you face the possibility of having to serve your original jail sentence. A persuasive argument must be made to the court that your probation violation didn't occur or was minor in nature.
- Expunging a felony or misdemeanor conviction: If your conviction was for a felony, a California court must first reduce it to a misdemeanor before expungement. If the conviction was for a misdemeanor, you must in most cases have successfully completed probation. The court can then be petitioned for post-judgment relief.
- Dismissal after a misdemeanor conviction when no probation was granted: You must have complied with the terms of your sentence; you must not currently be charged with any crime; you must not be serving any other sentence. Under these and other conditions, you may petition the court to dismiss a misdemeanor conviction.
The language of the law is complicated and convoluted. I will make it clear to you as it applies to your case. I'll also answer your questions, return your calls, and represent your best interests as we move forward in obtaining post-judgment relief for you.
Getting a conviction expunged can mean that your future job background checks will come up clear. It can make all the difference between getting a job you want and having to take any job available.
